4. Our Lawful Bases for Processing

UK data protection law requires us to have a lawful basis for processing your personal information.

Depending on the circumstances, we rely on:

Contract – where processing is necessary to process an order, take payment, arrange delivery or otherwise provide products or services you have requested.

Legal obligation – where we need to retain or process information to comply with tax, accounting or other legal requirements.

Legitimate interests – where necessary for the reasonable operation of BattCave, such as providing customer service, maintaining website and transaction security, preventing fraud and understanding how our website is used, provided those interests do not override your rights and interests.

Consent – where we specifically ask for your consent, including where consent is required for particular marketing activities or cookies and similar technologies. Where processing relies upon consent, you may withdraw that consent at any time.

5. Payments

We currently offer several ways to pay for an order.

Stripe

Where you choose a payment method processed by Stripe, information necessary to process the transaction is provided to Stripe.

Stripe processes payment information in accordance with its own privacy and security policies. BattCave does not need to receive or store your complete payment-card details in order to process these payments.

PayPal

Where you choose to pay using PayPal, payment information is provided to and processed by PayPal in accordance with its own privacy policy and terms.

BattCave receives the information necessary to confirm and manage your payment and order.

Direct Bank Payment

Customers may also choose to pay by direct bank payment.

When this option is selected, we provide our bank account details so that you can make payment directly from your bank.

We may receive information associated with the payment from our bank, such as your name, payment reference, amount and transaction information. We use this information to identify the payment, reconcile it against your order and maintain appropriate financial records.

We will never ask you to provide us with your online banking password, PIN or other banking security credentials.

We may provide Royal Mail with information reasonably necessary to deliver and manage your parcel, which may include your:

  • Name

  • Email address
  • Telephone number
  • Delivery and tracking information

Royal Mail processes this information in accordance with its own privacy obligations.

7. Website Analytics

Our webshop uses analytics and similar technologies to help us understand how visitors use the website.

This may include information such as pages visited, approximate location, referring website, browser or device type, IP address and interactions with the website.

We use this information internally to understand website performance, identify problems and improve our website, products and customer experience.

We do not sell personal information collected through our website analytics.

Where analytics or similar technologies require consent under applicable law, they will only be used after the appropriate consent has been obtained.

8. Cookies and Similar Technologies

Our website uses cookies and may use other similar technologies.

These technologies can store information on, or access information from, the device you use to visit our website.

Some are strictly necessary for the operation of the website. For example, they may be required for shopping basket functionality, checkout, website security or remembering essential settings.

Other technologies may be used for purposes including:

  • Website analytics
  • Understanding how visitors use our website
  • Remembering preferences
  • Improving website performance and functionality
  • Providing embedded third-party content

Where consent is legally required for a cookie or similar technology, we will ask for that consent before using it.

You can manage available cookie choices through our website's cookie controls and may also control cookies using your browser settings.

Blocking certain cookies may affect the operation or functionality of the website.

9. Google reCAPTCHA

Our website may use Google reCAPTCHA on forms or other parts of the website to help protect BattCave and its customers against spam, automated submissions, fraud and abuse.

When reCAPTCHA is used, Google may collect information about your device and interaction with our website in order to determine whether an interaction is likely to have been made by a person rather than an automated system.

Information processed by Google is subject to Google's applicable privacy terms and policies.

10. Embedded Content

Our website may contain content provided by third parties, including embedded videos from YouTube.

When you view or interact with embedded third-party content, the provider may receive information about your device and interaction with that content and may use cookies or similar technologies.

The processing of information by these third parties is also governed by their respective privacy policies.

Where consent is legally required before third-party technologies are activated, we will obtain that consent as required.

11. Email Marketing

We occasionally send emails about BattCave products, new products, stock availability, news, offers or other information that may be relevant to our customers.

We only send electronic marketing where permitted under applicable UK data protection and electronic marketing laws.

Where you have specifically asked or consented to receive marketing from us, we may contact you in accordance with that request or consent.

We may also send marketing about our own similar products and services to existing customers where permitted by law. Where we rely on this existing-customer provision, you will have been given an opportunity to opt out when your contact details were collected and will be given an opportunity to opt out in each subsequent marketing communication.

You can unsubscribe from marketing communications at any time by using the unsubscribe option provided in the communication or by contacting us at sales@battcave.co.uk.

Unsubscribing from marketing will not prevent us from sending essential communications relating to an order, payment, delivery or customer-service matter.

12. Who We Share Information With

We do not sell your personal information and we do not provide customer information to unrelated third parties for them to use for their own marketing.

We may provide personal information to trusted organisations where necessary to operate BattCave, including:

  • Government, tax, regulatory, law-enforcement or other authorities where we are legally required to provide information

We only provide information reasonably necessary for the relevant purpose.

13. International Transfers

Some service providers and technology companies we use may process or store personal information outside the United Kingdom.

Where personal information is transferred internationally, we take reasonable steps to ensure that an appropriate lawful transfer mechanism or safeguard required by UK data protection law is in place.

14. How Long We Keep Your Information

We do not keep personal information for longer than reasonably necessary.

How long information is retained depends upon why it was collected and whether we have a legal or legitimate business requirement to retain it.

Information relating to purchases, payments and financial transactions may need to be retained for several years to meet UK tax, accounting and legal requirements.

Customer correspondence and other information may be retained for a reasonable period where necessary to deal with enquiries, disputes, warranties, fraud prevention or other legitimate business requirements.

Where we retain information relating to a marketing opt-out, we may retain sufficient information to ensure that your preference continues to be respected.

When personal information is no longer required, we will delete it or otherwise dispose of it appropriately.

15. Security

We take reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

However, no internet service or electronic communication system can be guaranteed to be completely secure.

You are responsible for keeping any password or account credentials used on our website confidential.

16. Your Data Protection Rights

Depending upon the circumstances, UK data protection law gives you rights over your personal information, including the right to:

  • Ask for a copy of personal information we hold about you
  • Ask us to correct inaccurate or incomplete information
  • Ask us to delete personal information in certain circumstances
  • Ask us to restrict the way we process your information in certain circumstances
  • Object to certain processing
  • Receive certain information in a portable format where applicable
